Please read these Terms of Service carefully before using our website or placing an order.

1. Who We Are

This website and store, Veruca Fallbrook, is operated by IWANTITNOW Corp. dba Veruca ("Veruca," "we," "us" or "our"), 1873 Diamond St, Ste 102, San Marcos, CA 92078. In these Terms, "Service" means our website at www.veruca.com and its store pages, and the ordering, delivery, pickup and customer service we provide through it. "You" means the person using the Service, or the company or other legal entity on whose behalf that person is using it.

2. Acceptance of These Terms

By accessing or using the Service, or by placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy and Shipping Policy, which are part of these Terms. If you do not agree, please do not use the Service. You must be at least 18 years old to use the Service or place an order.

3. Orders

By placing an order, you confirm that you are legally able to enter into a binding contract and that the information you provide, including your name, email, phone number, payment details and delivery address, is accurate and complete. You authorize us and our payment processors to charge your selected payment method for the total shown at checkout.

We may refuse or cancel an order for reasons including product availability, errors in product descriptions or pricing, errors in your order, delivery addresses outside our service area, or suspected fraud or unauthorized transactions. If we cancel an order after you have been charged, we will refund the charge.

4. Products, Pricing and Availability

We work to display products, prices, images and descriptions accurately, but errors and delays in updating information can happen. We do not guarantee that all information on the Service is accurate, complete or current, and we may correct errors and change prices or availability at any time without notice, including after an order is submitted but before it is fulfilled. Product images are for illustration, and packaging may vary.

5. Delivery

We deliver only within our local delivery area. Delivery windows, our 30-minute delivery guarantee and its restrictions are described in our Shipping Policy and on our 30 Minute Delivery or It's FREE page. Risk of loss passes to you when your order is delivered to the address you provided.

6. Returns, Refunds and Cancellations

Returns, refunds and order cancellations are handled as described in our Refund Policy. To change or cancel an order, please call us right away at 760-484-4922, since we begin packing orders as soon as they are placed.

7. Subscriptions and Memberships

Some products or services may be offered on a recurring or membership basis. If you sign up for one, you will be billed in advance on the recurring schedule shown at signup until you cancel. You can cancel future renewals through your account or by contacting us. Fees already paid for a current period are non-refundable except where required by law, but you will keep access until the end of that period. We will give you reasonable advance notice of any change to recurring fees, and continuing your subscription after the change takes effect means you accept the new fee.

8. Promotions, Discounts and Gift Cards

Discount codes, promotions and giveaways are subject to their stated terms, may be limited in time or quantity, cannot be combined unless stated, and may be changed or ended at any time. Gift cards and store credit have no cash value except where required by law and are not redeemable for cash.

9. Your Account

If you create an account, you are responsible for keeping your login details secure and for all activity under your account. Please notify us right away of any unauthorized use. We may suspend or close accounts that violate these Terms.

10. Acceptable Use

You agree not to misuse the Service, including by interfering with its operation, attempting to gain unauthorized access, placing fraudulent orders, or using the Service for any unlawful purpose.

11. Third-Party Services and Links

The Service may include links to, or features provided by, third-party websites and services that we do not own or control. We are not responsible for their content, policies or practices, and your use of them is at your own risk.

12. Disclaimer

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or free of harmful components. Some jurisdictions do not allow these exclusions, so they may not fully apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, Veruca and its suppliers will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the order giving rise to the claim, or $100 if you have not made a purchase. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

14. Termination

We may suspend or end your access to the Service at any time, without notice, if you violate these Terms. You may stop using the Service at any time.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If you have a concern, please contact us first so we can try to resolve it informally. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in San Diego County, California.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted here with a new "Last updated" date. If a change is material, we will make reasonable efforts to give notice before it takes effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

17. Severability

If any part of these Terms is found unenforceable, the rest will remain in effect, and the unenforceable part will be applied to the fullest extent permitted by law. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
